PRIVACY POLICY

Thank you for visiting Intelligent Health Management Platform (“IHMP”) and XpressRx Inc. (“XpressRx”) (together, “we,” “our,” or “us”) websites (the “Sites”). The protection and privacy of personal data is very important to us.  The IHMP and XpressRx Privacy Policy (the “Policy” or “Privacy Policy”) covers information received from our Sites and in connection with the products and services that IHMP and XpressRx offer and how the information may be collected, used, disclosed, retained, and destroyed. 

By utilizing the Sites and any of our services (collectively the “Services”), you expressly acknowledge and accept this Privacy Policy.  This Privacy Policy is incorporated into the Terms of Use of our Services.  Additional terms may apply in connection with services provided by IHMP and XpressRx to customers under specific agreements between IHMP and XpressRx and the customer.    

What Information Do We Collect About You?

We collect information you provide directly to us. We collect information that you voluntarily provide when you use our Sites, such as when you register to “Stay in Touch,” and/or contact us with a question, comment, or request. The information may include the following categories: 

 

  • Personal Identifier and Other Information: Your name, date of birth, address, email, phone number, age, username, and password, marital information, medical information, and health insurance information and policy number. 

 

  • Sensitive Personal Information: Social security information, driver’s license or state identification card information, racial or ethnic origin, genetic data information, and personal information collected and analyzed concerning health, sex life, or sexual orientation.

 

  • Commercial Information: Payment and account information, demographic information, goods and services preferences, usage history and communications with us. 

 

  • Internet/Electronic Activity, Device Information, Usage Information: Your precise geolocation information, Internet Protocol (IP) address information that may identify your computer, mobile device, tablet, or other device or browser, information about your operating system and browser, including the hardware model and mobile network information web/app browsing and search history related to our Services, and information regarding your interactions with the Services.

 

  • Profile Inferences: Inferences that we draw from the above categories of information and web activity to create a personalized profile to better identify the services that may be of interest to you. 

 

  • Biometric Identifiers and Biometric Information: “Biometric Identifier” means a fingerprint, voiceprint or scan of face geometry. “Biometric Information” means any information, regardless of how it is captured, converted, stored, or shared, based on your Biometric Identifier used to identify you. 

 

There are several ways we may obtain information about you, including:

  • Directly. You, when you provide us information.  If you submit personal information relating to other people to us, you represent that you have the authority to do so and to permit us to use the information with accordance with this Privacy Policy.  

 

  • Indirectly. You, when you interact with our Services that are automatically or passively collected. We may automatically collect certain information from you, including your IP address, device information for the computer, mobile device, tablet or other device, including the hardware model and mobile network information, browser type, operating system, products or services you purchase or access, content, screens or pages viewed and interactions with content, screens or pages, URL and the preceding page views or websites visited, what third party referred you to our Services, and mobile device configurations.

 

  • Third parties.  For example, we may use third-party technologies to automatically collect certain information.  We may use other companies’ analytics, tracking and provided tools that receive information when you visit our Sites, including technology from Google, Facebook and others, to help us track, segment, and analyze usage of the Sites, and to help us or those companies serve more targeted advertising. These tools may use technology such as cookies, tags, pixels, SDKs, and similar technologies to track online activity. The companies may also combine information they collect from your interaction with the Sites with information they collect from other sources. We may not have access to information these companies collect using cookies or other tracking technologies.

 

By registering, or providing your contact information, you consent to IHMP and XpressRx sending you communications related to services or products provided by IHMP and  XpressRx. You will have an opportunity to opt-out of receiving communications by following the instructions provided in the communication or you can contact [email protected] if you are unable to do so. 

How Do We Use Your Information?

We do not sell or rent personal information about visitors to the Sites.  However, we may use your information to provide our Services and for a variety of related business activities, which may include: 

  • to provide customer support;
  • to provide you with information about our services, our products, programs, your accounts, and notices; 
  • to deliver marketing communications that may be of interest to you;
  • to help us, our subsidiaries, affiliates, and business partners better understand our audiences, improve the services, and perform other market research activities;
  • for our business purposes, such as modifying the services, monitoring and prevention of fraud, detection of security incidents, infringement, data analysis, audits and/or determining the effectiveness of our business activities;
  • to authenticate your identity; and 
  • to comply with our legal obligations; and for other legitimate and lawful business purposes. 

 We may combine the various information we collect about you, including account information, identifying information, usage information, as well as information collected offline, across other computers or devices that you may use, and from third-party sources.  If you contact us for support or assistance, we may use information about you or your system that you provide or that we collect for the purposes such as verifying whether your system meets the minimum requirements needed to use the Sites and our services. 

 

With whom do we share the information we collect?

The information we collect from and about you may be disclosed:

 

  • to third parties, including but not limited to Twilio, Voiceit, and OpenAI, that provide services to us, such as fulfilling requests for information, administering programs or projects, assisting in research and development, or delivering other communications;
  • to business partners who offer products or services jointly with us or our subsidiaries or affiliates; 
  • as required by law, such as to law enforcement, to health authorities to report possible adverse events, as ordered or directed by courts or other governmental agencies, during government inspections or audits, or in order to comply with a subpoena or other legal process;
  • when we believe in good faith that disclosure is necessary to protect legal rights or the security or integrity of the company; protect your safety or the safety of others; investigate fraud, breach of contract, or violation of law; or respond to a government request; and
  • to third parties, advisors, and other entities to the extent reasonably necessary for development of or to proceed with the negotiation or completion of a corporate or commercial transaction, including merger, acquisition, financing, joint venture, sale or other disposition of all or a portion of our business, assets, or stock.

 

Collecting and using and disclosing personal information

Except as disclosed in this Privacy Policy, we do not collect any personally identifiable information about visitors to the Sites.

 

Children’s Information

Our services are not intended for the use of children under the age of 18 without parental consent. If you are under the age of 18, please do not attempt to provide any personal information to us directly without parental consent.  Additionally, we do not knowingly collect personal information from individuals under the age of 13 and we do not direct our services to individuals under the age of 13.  If we learn we have collected or received the personal information of a child under 13, we will delete that information. Your Choices

Where you have chosen to participate in one of our contact forms to receive communications from us, we may offer you the ability to discontinue your participation or to opt out of receiving those communications in the communications itself, or you can visit our contact us page or email us at [email protected]

Privacy Rights and Privacy Notice

In accordance with the California Consumer Privacy Act of 2018 and the California Privacy Rights Act of 2020, the Colorado Privacy Act, the Virginia Consumer Data Protection Act, the Connecticut Data Privacy Act, and the Utah Consumer Privacy Act, this Privacy Policy is also intended to serve as Notice describing the policies and practices of IHMP and XpressRx with respect to (1) the categories and types of personally identifiable information (“PII”) IHMP and  XpressRx collects about individuals who utilize the Sites and Services and who reside in California, Colorado, Virginia, Connecticut, and Utah, and (2) the purposes for which IHMP and XpressRx use your PII.  

For purposes of this Notice, PII about you means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household.

 Sale Opt-Out Notice If you are a California, Colorado, Utah, Connecticut, Virginia, or Iowa resident, relevant privacy laws provide you with the right to opt out of the “sale” of your “personal information.” “Sale” means the sharing of personal information with third parties who are not acting as our service providers. As explained in our Privacy Policy, we do not currently sell your personal information to third parties. 

Biometric Privacy Policy

In order to accurately authenticate your identity, IHMP and XpressRx and our vendors, including Vivo, may use an authentication system based on your fingerprint, voiceprint and/or scan of your face geometry.  The scans are unique to the individual and are captured following your registration for the Services and signing of a biometric consent form. 

The fingerprints, voiceprints and scans of face geometry are stored by us or our vendors, including Vivo, and are not used for any other purpose other than identity authentication.  They are protected in accordance with the policies and procedures of IHMP and  XpressRx related to sensitive and confidential information and will not be shared with any external party unless (a) consent of the individual affected is given, (b) disclosure is necessary to complete a financial transaction requested or authorized by the subject, (c) disclosure is required by law or (d) is required by subpoena.

Retention Period

The information that you voluntarily provide to IHMP and XpressRx, including the fingerprint, voiceprints and scans of face geometry, will be maintained for the earlier of: (1) the initial purpose for obtaining the information has been satisfied; or (2) within three years after your last interaction with IHMP or XpressRx necessitating the information. Following the expiration of this period, the information will be deleted from IHMP’s and XpressRx’s systems. 

 

Changes to the Policy

We may revise this Privacy Policy as we add new features or modify the way in which we manage information, or as laws change that may affect our services. If we make material changes to our Privacy Statement, we will provide you with appropriate notice in accordance with legal requirements. Any revised Privacy Statement will apply both to information we already have about you at the time of the change, and any personal information created or received after the change takes effect. By continuing to access and use the Sites, you are confirming that you have read and understood the latest version of the Policy.
